What is SB 721?

The first inspection must be completed by January 1, 2026 (note: extended to 2026 in some municipalities), with follow-ups every 6 years.
What is SB 326?
SB 326 applies to condominium buildings or any building with a common interest development (CID). It requires the inspection of elevated elements that are maintained by the HOA. The first inspection must also be completed by January 1, 2026, with repeat inspections at least once every 9 years thereafter.
Who is responsible for ensuring compliance?
For SB 721, the responsibility lies with property owners or property management companies.
For SB 326, it falls to the HOA board of directors or their appointed management company. Failure to comply may result in legal liability or fines, and disclosure is required in some real estate transactions.
What types of structures need to be inspected?
Typical exterior elevated elements (EEEs) subject to inspection include:
